Brand Starter Academy — Terms of Service

1. Agreement to Terms

By enrolling in, accessing, or purchasing Brand Starter Academy (the "Program," "we," "our," "us"), you ("Student," "you") agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not enroll or use the Program.

2. Eligibility & Authority

You are at least 18 years old or the age of majority in your province/territory, whichever is greater.
If enrolling on behalf of a business, you have authority to bind that business.
You confirm you are participating for business or professional purposes.

3. Program Access & License

Upon payment, you receive a limited, non-exclusive, non-transferable, revocable license for personal business use only.
You may not copy, distribute, sublicense, resell, reverse-engineer, or exploit Program materials.
Sharing login credentials or providing third-party access is prohibited.
Violation may result in immediate revocation of access without refund and potential legal action.

4. Payments, Billing & Chargebacks

All fees are in United States Dollars (USD) unless otherwise stated.
Payment plans must be completed in full. Missed payments may result in suspension, acceleration of remaining payments, or collections.
You authorize recurring billing if you select an installment or subscription plan.
Chargebacks: Contact reetu@onlinebrandstarter.com before initiating a chargeback. Filing a chargeback without doing so breaches this Agreement. We may suspend access, recover amounts owed (including collection costs, legal fees, and interest), and provide evidence to processors to contest chargebacks.
We may adjust prices for future enrollments or renewals with at least 30 days' notice.

5. 90-Day Conditional Money-Back Guarantee

Unless explicitly stated otherwise on the sales page, this Program is backed by a conditional 90-Day Money-Back Guarantee.

Eligibility requires that, during the first 90 days of access, you:

Complete all recorded training materials,
Attend a minimum of 75% of live coaching sessions, and
Demonstrate a documented, good-faith implementation effort of the strategies taught.

Refund requests may only be submitted after Day 90 and before Day 180 from the date access is granted. Requests submitted before Day 90 or after Day 180 will be automatically denied.

Requests must be sent to reetu@onlinebrandstarter.com and include all required proof. Incomplete submissions will not be reviewed.

Approved refunds will be processed within 10 business days following approval.

Subscription cancellations must be submitted at least 10 days prior to the next billing date and do not qualify for prorated or retroactive refunds.

6. No Guarantee of Results

We provide education and strategies but do not guarantee income, profits, or specific outcomes. Your results depend on your effort, business model, and market conditions. Testimonials are individual experiences and not promises.

7. Confidentiality, Community Conduct & Non-Solicitation

Respect the confidentiality of other students' information shared in sessions or communities.
Harassment, hate speech, discrimination, or unethical behavior may result in immediate removal without refund.
Do not solicit other students for unrelated products or services without our written consent.

8. Intellectual Property Rights

All Program content, including videos, templates, workbooks, and branding, is protected under copyright, trademark, and other IP laws. Unauthorized use may result in civil or criminal liability.

9. Testimonials, Reviews & Media

Brand Starter Academy is pleased to hear from students and may use testimonials, reviews, photographs, videos, or similar content ("Submissions") you voluntarily provide. By submitting or sharing a Submission with us (including in our community groups or live sessions), you grant Brand Starter Academy a royalty-free, worldwide, perpetual license to use, reproduce, edit for length or clarity, publish, and display the Submission, in whole or in part, together with your first name, city, and province/territory, in any media or format, for promotional, marketing, or educational purposes.

Testimonials represent individual experiences and do not guarantee similar results. We may, at our sole discretion, shorten or decline to use any Submission. Submissions are treated as non-confidential and non-proprietary unless you expressly state otherwise in writing before providing them.

10. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for indirect, incidental, consequential, punitive, or special damages arising from your participation.
Our total liability is limited to the amount you paid for the Program within 90 days preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Brand Starter Academy, its owners, employees, contractors, and affiliates from all claims, damages, liabilities, costs, and expenses (including legal fees) resulting from:

Your use or misuse of the Program;
Breach of these Terms;
Violation of any law or third-party rights.

12. Dispute Resolution, Governing Law & Venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Attempt to resolve disputes in good faith by contacting reetu@onlinebrandstarter.com within 30 days of the issue.
If unresolved, disputes shall be finally settled by binding arbitration administered by the ADR Institute of Canada (ADRIC) under its Arbitration Rules.
The seat of arbitration is Toronto, Ontario, and proceedings will be in English.
Arbitration will proceed on an individual basis only. Class or representative actions are waived.
Judgment on the arbitration award may be entered in any court of competent jurisdiction.

13. Modifications to Terms

We may update these Terms by posting a revised version on our website or emailing you. Continued participation after updates constitutes acceptance.

14. Severability & Entire Agreement

If any provision is found invalid, remaining provisions remain enforceable. These Terms, plus any policies or guarantees referenced at purchase, form the entire agreement between you and Brand Starter Academy.
